Explorers Birthday Party Terms & Conditions
These Terms and Conditions (the “Terms”) govern the booking of a birthday party at Explorers, operated by Majid Al Futtaim Entertainment LLC (“MAF Entertainment”, “we”, “us” or “our”). By signing the booking form and/or paying the deposit, the person making the booking ( “Organiser”, “you” or “your”) confirms that they have read, understood and agree to be bound by these Terms on behalf of themselves and all guests attending the party.
1. Booking and Confirmation
1.1 A booking is confirmed only once the booking form has been signed and the required deposit has been received by MAF Entertainment. Until both are received, no date, time or space is reserved or guaranteed.
1.2 A minimum of ten (10) children per party applies to all birthday party bookings . 1.3 All prices are quoted in UAE Dirhams (AED) and are inclusive of VAT.
2. Deposit and Payment
2.1 A non-refundable deposit of fifty percent (50%) of the total booking fee, to be paid at time of booking, is required to confirm the booking. The deposit is applied towards the total cost of the party.
2.2 The remaining balance must be paid in full on or before the date of the event prior to entering the premises.
2.3 If additional guests attend on the day of the event, you are responsible for any resulting additional charges, payable on the day.
2.4 Optional extras and add-ons must be requested and confirmed in advance and may be subject to additional charges. Adults are not included in the children’s meal package.
3. Cancellations, Changes and Refunds
3.1 The deposit is non-refundable in all circumstances, including where you cancel the booking or fail to attend (a “no-show”).
3.2 Any request to cancel or amend a confirmed booking must be made in writing to events.explorers@maf.ae.
3.3 Any change to a confirmed booking, including the event date, event time, or number of attendees, requires at least 72 hours’ notice prior to the scheduled event and is subject to availability. Any change requested with less than 72 hours’ notice will be treated as a cancellation.
3.4 Refunds on cancellation are subject to the following: (a) the deposit is non-refundable in all circumstances; (b) the balance (being any amount paid above the deposit) will be refunded only if the booking is cancelled more than three (3) weeks before the date of the event, so that where the full price has been paid the remaining 50% will be refunded if the booking is cancelled more than three (3) weeks before the event; and (c) any cancellation made three (3) weeks or less before the date of the event is non-refundable.
3.5 Guests are encouraged to arrive at least 15 minutes before the scheduled start time. In the event of late arrival, the party will still conclude at the originally scheduled end time. No extension, refund or credit will be provided for time lost due to late arrival.
3.6 MAF Entertainment reserves the right to cancel or reschedule a booking due to circumstances beyond its reasonable control (including force majeure, technical failure or safety concerns). In such cases, MAF Entertainment will offer an alternative date or a refund of sums paid, which shall be your sole and exclusive remedy.
4. Supervision and Responsibility for Guests
4.1 Children must be supervised by the Organizer at all times, and the Organizer is responsible for the conduct of its guests and for ensuring its guests comply with venue rules, attraction restrictions, safety requirements and staff instructions. Nothing in this clause limits any responsibility of MAF Entertainment for the safe operation of its venue (see clause 5).
4.2 All guests are expected to behave in a safe and respectful manner at all times. MAF Entertainment reserves the right to remove, or deny access to, any guest whose behaviour is deemed unsafe, disruptive or inappropriate, without refund.
5. Limitation of Liability
5.1 Nothing in these Terms excludes or limits MAF Entertainment's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under the laws of the United Arab Emirates.
5.2 Subject to clause 5.1, MAF Entertainment shall not be liable for any indirect or consequential loss, and its total liability arising out of or in connection with a booking shall not exceed the total fees paid to MAF Entertainment for that booking.
5.3 MAF Entertainment shall not be liable for any loss or damage caused by the failure of the Organiser or any guest to comply with these Terms, venue rules, attraction restrictions, safety requirements or staff instructions.
6. Damage and Personal Belongings
6.1 You are fully responsible for any loss, damage or breakage to venue property, equipment, furniture or fixtures caused by your guests during the party. MAF Entertainment reserves the right to charge the Organiser for the cost of repair, replacement or cleaning resulting from such damage.
6.2 MAF Entertainment is not liable for any loss, damage or theft of personal belongings brought onto its premises.
7. Food and Beverages
7.1 Outside food and beverages are strictly prohibited on MAF Entertainment premises, with the sole exception of a birthday cake.
7.2 Where a birthday cake, or any other food or beverage item, is brought onto the premises from a third party (i.e. not supplied by MAF Entertainment), it is brought in and consumed entirely at your and guests’ own risk. MAF Entertainment accepts no responsibility or liability whatsoever for any illness, allergic reaction, food poisoning, injury, loss or other consequence arising from the consumption of any food or beverage not supplied by MAF Entertainment. The Organiser releases, and agrees to indemnify and hold harmless, MAF Entertainment against any and all claims, costs or liabilities arising from or in connection with such third-party food or beverages.
7.3 Medically necessary and dietary-specific foods may be brought in only after prior consultation with, and the approval of, site management.
7.4 Any dietary requirements, including allergies, must be disclosed to the venue at the time of booking to allow for necessary precautions. As our venues handle a variety of allergens, MAF Entertainment cannot guarantee that any meal or item will be completely free from allergens.
8. Health, Safety and Medical
8.1 All medications, including EpiPens, must be carried and administered by the relevant parent or guardian in the event of an emergency. MAF Entertainment staff are not authorised to administer medication.
8.2 The Organiser must ensure that all attending children are in good health and fit to take part in the activities. Any medical condition, allergy or other requirement relevant to a child's participation must be disclosed to the venue in advance.
8.3 Use of the play areas, attractions and equipment carries inherent risks of active physical play. Save as set out in clause 5.1, participation is at the participant's own risk to the extent of those inherent risks that remain after MAF Entertainment has taken reasonable care.
9. Photography, Marketing and Safeguarding
9.1 MAF Entertainment may take photographs or video within its premises for security purposes and, where consent has been given, for marketing or promotional purposes. If you do not wish images of your party or your guests to be used for marketing, please notify site management in writing before the event.
9.2 Guests may take photographs or video of their own party for personal use only. Photographing or filming other guests, children or staff who are not part of your party is not permitted without their consent.
10. Data Protection
10.1 MAF Entertainment collects and processes the personal data provided in connection with a booking (including names, contact details and any dietary, allergy or medical information) for the purposes of managing the booking and ensuring guest safety, in accordance with the UAE Personal Data Protection Law (Federal Decree-Law No. 45 of 2021) and MAF Entertainment's privacy policy.
10.2 By making a booking, you confirm that you are authorised to provide the personal data of your guests and to consent to its processing for these purposes on their behalf.
11. General
11.1 MAF Entertainment reserves the right to amend these Terms at any time at its sole discretion. The Terms in force at the time of booking will apply to that booking.
11.2 These Terms are governed by, and construed in accordance with the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates. The parties irrevocably submit to the exclusive jurisdiction of the courts of Dubai.
11.3 The person making the booking confirms that they are at least 18 years of age and are authorised to accept these Terms on behalf of themselves and all guests attending the party.
11.4 If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
11.5 Any third-party supplier, entertainer, decoration or service arranged by the Organiser must be approved by site management in advance. The Organiser is responsible for the acts and omissions of any such supplier and releases MAF Entertainment from any liability arising from them.
